1. Introduction

This document outlines the terms and conditions ("Terms") that govern your use of MoodBrush mobile application ("App"), developed and operated by Ahancer Company Limited. By accessing or using the App, you agree to be bound by these Terms.

2. Use of the App

2.1. You must be at least 4 years old to use this App. If you are under 4, you must have your parents or legal guardian to use the App.

2.2. If the Minimum Age for using, accessing, or purchasing our Services or related products is higher under applicable laws than what we have set, then you must adhere to the older age requirement specified by such laws.

2.3. You may not use the App in any manner that could damage, disable, overburden, or impair our servers or networks.

3. Privacy

3.1 To better understand app usage and improve our services, we employ tools like Google Analytics. These tools help us analyze user data in a manner that aligns with our commitment to your privacy. We ensure that all data handled through these tools is managed responsibly and in accordance with our privacy policies.

4. In-App Payments

4.1. The App may offer in-app purchases or subscription packages to access its full features.

4.2. All information that you provide in connection with your purchase or transaction or other monetary transactions interacting with the App must be accurate, complete, and current. You agree to pay all charges incurred by your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the App at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.

4.3. All financial transactions made in connection with the App will be processed by a third party in accordance with their respective terms of use, privacy policy, and/or any applicable payment terms and conditions. We encourage you to read about the practices of such third parties. In no event will Ahancer Company Limited be responsible for the consequences of any third party payment processor, including, but not limited to, system downtime or payment service outages.

4.4. In-app purchases and subscription packages are non-refundable.

4.5. Your purchase may be subject to additional terms and conditions imposed by the respective app store (Apple App Store for iOS devices and Google Play Store for Android devices). It is your responsibility to review and comply with the terms set forth by the relevant app store provider.

4.6. Ahancer Company Limited can revise the pricing for the goods and services offered through the App at any time.

5. Third-Party Links and Services

The App may contain links to third-party websites or services. We are not responsible for the content or privacy practices of any third-party website or service. You acknowledge and agree that you access and use any third-party website or service at your own risk.

6. Copyright and Service Content

6.1. The content provided through the App, including but not limited to software, text, graphics, images, soundtracks, and the user interface, is the property of Ahancer Company Limited or its licensors and is protected by copyright and other intellectual property laws. You acknowledge that all rights in and to the App content are owned by Ahancer Company Limited or its licensors.

6.2 Ahancer Company Limited utilizes sound effects and background music that are sourced from legally permissible, publicly available sources on the internet. Each piece of music and sound effect used in the App is either in the public domain, used under an appropriate Creative Commons license, or utilized with explicit permission from the copyright holder. Proper attribution for all sourced material is provided within the App, accessible via the 'Sound Credits' menu. Users can refer to this section for details on the sources and the terms under which they are used.

6.3. Ahancer Company Limited grants you a personal, non-exclusive, non-transferable, revocable license to use the App and its content for your personal, non-commercial use in accordance with these Terms and Conditions. This license is for the sole purpose of enabling you to use and enjoy the benefit of the services as provided by Ahancer Company Limited, in the manner permitted by these Terms.

6.4. Except as expressly permitted in these Terms or with the prior written consent of Ahancer Company Limited, you may not copy, modify, distribute, sell, lease, rent, or otherwise exploit the App or the content therein. You may not reverse engineer or attempt to extract the source code of the App, unless laws prohibit these restrictions or you have Ahancer Company Limited's written permission.

6.5. You agree not to use the App and its content in a manner that violates any applicable law, regulation, or this agreement. Prohibited uses include, but are not limited to, engaging in any data mining, robots, scraping, or similar data gathering or extraction methods directly or indirectly on the App content without express written permission from Ahancer Company Limited.

By using the App, you agree to comply with these terms and acknowledge that your use of the App is at your discretion and risk. Ahancer Company Limited reserves all rights not expressly granted to you under these Terms and Conditions.

Disclaimer

7.1. The App is provided "as is" and "as available" without any warranties.

7.2. MoodBrush does not guarantee the correctness or effectiveness of the brushing techniques suggested. It is the user's responsibility to ensure proper oral hygiene practices and consult with a dental professional for personalized advice.

7.3. Ahancer Company Limited disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the fullest extent permitted by laws, we will not be liable for any damages arising out of your use of the App, including, but not limited to, direct, indirect, incidental, consequential, and punitive damages.

9. Termination

9.1. Ahancer Company Limited may terminate or suspend your access to the App without notice, if you violate these Terms and Conditions.

9.2. Upon termination, your right to use the App will immediately cease.

10. Governing Law & Dispute Resolution

10.1. These Terms shall be governed by and construed in accordance with the laws of Thailand.

10.2. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of the Thailand laws. The arbitration shall be held in Bangkok, Thailand, and the arbitral award shall be final and binding on the parties.

11. Entire Agreement

These Terms constitute the entire agreement between you and Ahancer Company Limited with respect to your use of the App.

12. Updates and Changes

12.1. Ahancer Company Limited reserves the right to update or change these Terms and Conditions at any time without notice. We will notify you of any changes by posting the new Terms on the App.

12.2. It is your responsibility to check for updates to these Terms and Conditions regularly. Your continued use of the App after the posting of revised Terms constitutes your acceptance of the revised Terms.
